Court Update: AFGE v. Mullin Scheduling Order, June 3, 2026

On June 3, 2026, Judge Jamal Whitehead issued a revised scheduling order in Case No. 2:25-cv-00451-JNW. The September 2026 trial date has been struck. The new schedule ties all remaining deadlines to two pending motions. A trial is unlikely before late 2027.

Injunction Status

The preliminary injunction protecting the 2024 collective bargaining agreement remains in place and is not affected by this order.
One distinction is worth understanding clearly. The litigation protects collective bargaining rights under the CBA. Gold+ is authorized under a separate statute, 49 U.S.C. 44920, which governs TSA's authority to convert airports to private screening. These are two separate legal frameworks. The court's timeline in the collective bargaining case does not affect TSA's procurement authority under Gold+.

What Is Still Coming

TSA has confirmed the first Gold+ airports will be announced soon. Task order awards are targeted before September 30, 2026.
